1. Introduction

Welcome to Cubio, a 3D shape creation tool designed for use within the Canva platform. Cubio is published and operated by Mr. Paolo Straet (“we,” “us,” or “our”). By accessing or using Cubio, you (“User,” “you,” or “your”) agree to be bound by the following terms, privacy practices, and support guidelines. If you do not agree with any part of this document, you must not use Cubio.

This document combines the Terms of Service, Privacy Policy, and Support Information into a single, unified page for your convenience.

2. Description of Cubio

Cubio is a creative tool that enables users to generate and customize high-quality 3D objects. You can choose from a variety of shapes (such as cubes, spheres, and cylinders), apply advanced materials (like metal, glass, or matte), and fine-tune every aspect of the object, including deformations (twist, taper, noise), rotation, and lighting. The scene is enhanced with an HDR environment map for realistic reflections.

Cubio leverages the Three.js library for 3D rendering and uses icons from the @canva/app-ui-kit. All created elements are exported as high-resolution PNG images and inserted directly into your Canva designs. Cubio operates exclusively within the Canva platform.

3. License to Use

Subject to your full compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use Cubio solely for personal or internal business purposes, strictly within the Canva platform and in accordance with its intended functionality.

Mandatory Restrictions You are strictly prohibited from:

  • Copying, decompiling, reverse engineering, disassembling, or attempting to derive the source code of Cubio or any part thereof.

  • Distributing, selling, renting, leasing, lending, assigning, or sublicensing Cubio.

  • Using Cubio in any way that damages, disables, overburdens, disrupts, or impairs the Application, our servers, the Canva platform, or connected networks.

  • Using Cubio for any illegal, fraudulent, unauthorized, or unethical purpose, or in violation of these Terms or Canva’s terms of service.

4. Relationship with Canva

Cubio functions entirely within the Canva platform. Your use of Canva is governed solely by Canva’s own Terms of Service and Privacy Policy. We are not responsible for Canva’s features, availability, policies, or data handling.

5. Intellectual Property

a) Our Property All rights, title, and interest in Cubio—including its software code, user interface, and underlying technology—are owned exclusively by Paolo Straet and/or our licensors. Cubio incorporates third-party open-source libraries (notably Three.js) and assets (an HDR image from Poly Haven under a CC0 license), used under their respective licenses. These Terms do not transfer any intellectual property rights to you, except for the limited license granted in Section 3.

b) Your Created Content You retain full and exclusive ownership of any original 3D objects or illustrations you create using Cubio. We claim no rights over your content.

6. Your Responsibilities for Content

You are solely responsible for all content you create using Cubio. You agree that your content will:

  • Not infringe any third-party rights (copyright, trademark, etc.).

  • Comply with all applicable local and international laws.

  • Adhere strictly to Canva’s Terms of Use and Content Policies.

7. Privacy Policy

We respect your privacy and are committed to minimizing data collection.

a) Information We Do NOT Collect Cubio does not collect, store, transmit, or process any personally identifiable information (PII), including your name, email, Canva account details, or any content from your designs. We do not use cookies or any other tracking technologies.

b) Aggregated, Anonymous Data Canva may provide us with non-identifiable, aggregated usage data (e.g., frequency of shape usage) to analyze performance and improve features. This data contains no personal identifiers and cannot be linked to you.

c) Third-Party Services Cubio relies on the Canva platform. Canva has its own privacy practices, which govern how your data is handled. We encourage you to review Canva’s Privacy Policy.

8. Disclaimer of Warranties & Limitation of Liability

Cubio is provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that Cubio will be secure or error-free.

Limitation of Liability In no event shall Paolo Straet be liable for any indirect, incidental, special, or consequential damages. Our total cumulative liability to you for any claim related to Cubio shall not exceed €10.00.

9. Term and Termination

These Terms take effect when you first use Cubio and remain in force until terminated. We may terminate your access immediately if you breach these Terms. Provisions that by their nature survive termination shall remain in effect.

10. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of Belgium. Any dispute shall be subject to the exclusive jurisdiction of the courts of Liège, Belgium.

11. Miscellaneous Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and us regarding Cubio.

  • Severability: If any provision is found invalid, the remainder of the Terms shall remain in full force.

  • Assignment: You may not assign these Terms without our consent. We may assign these Terms without restriction.
